Navigating the Path to U.S. Residency
Expert Guidance for Consular Processing
At U.S. Immigration Law Group, we understand that the journey to obtaining U.S. residency can be complex, especially when going through consular processing. Our legal team provides comprehensive support throughout the consular processing journey, from initial petition approval to the final interview, ensuring you are fully prepared for each stage.
What is Consular Processing?
Consular processing is the procedure used by individuals outside the United States to apply for an immigrant visa at a U.S. Embassy or Consulate. Whether you are applying for a nonimmigrant visa (which grants a temporary stay) or an immigrant visa (which results in a green card), you will need to apply through the appropriate U.S. Consulate or Embassy.
This is different from the adjustment of status process, which is when a person applies for permanent residence (a green card) from within the United States. For example, individuals who obtain dual intent nonimmigrant visas (e.g. H-1B, O-1, L-1, K-1, etc.) can also apply to adjust their status. Unlike consular processing, adjustment of status does not require the prospective green card holder to apply for a visa from abroad.
- Initial Petition Approval: Before beginning consular processing, you must have an approved immigrant petition (such as Form I-130 or Form I-140). We assist in preparing and filing this petition, ensuring all documentation is accurate and complete.
- National Visa Center (NVC) Processing:
Once your petition is approved, it is sent to the National Visa Center (NVC). We help you navigate the NVC's requirements, including paying fees, submitting additional forms, and gathering required documents.
